Motorist avoids custodial sentence for second drink-drive offence

AN Easter Ross motorist escaped jail when he admitted his second drink driving offence at Inverness Sheriff Court.

Calum Mackay (23) was banned from consuming alcohol for two years by Sheriff David Sutherland and banned from driving for three years.

Sheriff David Sutherland heard police had been contacted and told that Mackay was driving and showing signs of having consumed alcohol/.

He stopped his vehicle on High Street, Avoch on the afternoon of September 22 and was found nearby by police officers who attended.

Mackay, of Rowan Drive, Culbokie admitted driving with 91 mcgs of alcohol per 100mls of breath which is more than four times the legal limit.

Solicitor Ken Ferguson said there was no justification for drink driving and it was his second offence.

But he said the background report suggested an alternative to custody.

He said Mackay had been consulting his GP to assist regarding his drink problem and he had been referred for specialist intervention.

Sheriff Sutherland placed Mackay on two years supervision with the requirement not to consume alcohol and disqualified him for three years from driving.

He was also ordered to carry out 160 hours of unpaid work.
