Trial hears Alness teen had underage sex with 14-year-old

A GIRL has told a trial that she had sex in the bathroom of a house in Alness with a 17-year-old boy when she was just 14.

Adam Muir (19) of Teaninich Street, Alness faces allegations of having unlawful sex with two underage girls and lewd and libidinous behaviour towards others.

A jury at Tain Sheriff Court was told by the girl, now 16, of the occasion when she had just met Muir for the first time, having been given his number by a friend.

She told a jury she had drunk two glasses of vodka and walked from Invergordon to Alness and met the boy, who she identified in court as Muir.

Questioned by Depute fiscal Roderick Urquhart, she said Muir took her to the house which she thought was his and she didn’t think anyone else was at home.

She said "we slept together" in the bathroom.

"By that you mean you had sex?" asked the fiscal depute.

"Yes," she replied.

The girl said she undressed herself and Adam took off his jeans and tracksuit top. She said they were there for about ten to 15 minutes.

Mr Urquhart told the girl, who cannot be named for legal reason, she may be asked of she had made this all up.

But she said that was not the case.

Mr Urquhart said when she was interviewed by police on February 9, 2010 she had told them she had sex twice with Muir.

But she said she got muddled up and had sex with another boy about five weeks earlier.

Cross-examined by Graham Mann, defence solicitor for Muir, he said the girl kept a diary and he found it surprising she hadn’t recorded that in her diary.

"When you were asked if you had sex with him twice you ruled out once. Is there a chance you can throw that out too," asked Mr Mann.

"No," said the teenager.

She admitted making things up to the police in the statement claiming that they had sex in a bedroom because she didn’t want them to think she would have sex in a toilet.

"Is it the truth he never touched you in his life," asked Mr Mann.

"No," said the girl.

Mr Mann suggested she had put round the rumour she had sex with Muir to get back at a friend. She said she did want to get back at a friend, but she did have sex with Muir.

The court also heard from a girl who claimed she was kissed at a party in woods at Alness by Muir when she was 13. Another girl claimed she was kissed by him at a house party but when interviewed by police they were surprised because they thought they had done nothing wrong.

Earlier the trial heard from a girl who claimed when she was 14 she had sex with Muir after police broke up a drinks party in the woods.

Another witness who was 15 at the time said Muir told her he was 15 and they went into a tent during an another party in the woods and he put his hands down her trousers.

She said he also took of her bra and asked her to perform a sexual act on in which she did.

She said about two weeks after this incident they were in a tent together and she said Adam wanted to have sex .

"The same happened as the last time but he wanted to have sex so I left," she said.

She denied she had got this incident mixed up with someone else.

The offences, involving a total of seven girls aged between 13 and 15, are alleged to have taken place at the woods and various locations around Alness including a derelict house between April 1, 2009 and August 17, 2010.

Muir has lodged a special defence of alibi to some of the charges which include having unlawful sex with a 14 and fifteen year-old girl, supplying alcohol to a 13 and 14-year-old and kissing them on the mouth, lewd and libidinous behaviour and attempting to have sex with a 15-year-old girl in a tent and kissing three 13 year-olds on the mouth.

None of the girls can be identified for legal reasons.

The trial continues.
