Alness man who plunged victim’s head in water jailed for 21 months

A 35-year-old Alness man who plunged the head of his 72 year old victim into a basin of water several times was jailed for 21 months at Inverness Sheriff Court.


Kamil Faron was the last of three accused to be sentenced by Sheriff Ian Cruickshank after he admitted assaulting a younger man and the pensioner in a house in Milnafua, Alness on September 10 last year.


The pair had been drinking with a female companion at the address when Faron and his fellow two accused stormed in.


Faron had pleaded guilty before the trial of two other Alness men, 38-year-old Cyprian Stawikowski and 34-year-old Przemyslaw Pyszka who were convicted of assaults and threatening behaviour during the same incident.


Stawikowski was previously jailed for two years for assaulting the younger man and the woman by slapping and repeatedly punching them on the head while Pyszka was fined £940 for threatening behaviour.


Sentence had been deferred on Faron for a background report.

Inverness Sheriff Court heard that Faron of Westford, Alness had entered the property and struck the younger man on the head, pulled him to the floor and repeatedly punched him on the body to his injury and permanent impairment.

The court was told that the victim said he had been left with tinnitus, headaches and seeing flashing lights and stars following the attack.


Defence solicitor advocate Clare Russell told the court: "There had been previous animosity between them. He seems to be of the opinion that solving matters physically is something that is done in Poland."


Sheriff Cruickshank was critical of Faron's attitude towards the offences, saying: "He does not hold any responsibility for holding a 72-year-old man's head underwater for a few seconds at a time.”

He added: "That had a profound and lasting effect on him given the content of his impact statement."
